Terms & Conditions – Go Fish Yamba Charters
By booking with Go Fish Yamba Charters, you confirm that you have read, understood, and accepted these Terms & Conditions. You also acknowledge that you accept these terms on behalf of all persons included in your booking.
Please review your booking prior to your charter, as these Terms & Conditions may be updated at any time.
1. Liability
Go Fish Yamba Charters is not liable for any indirect, incidental, or consequential costs associated with your booking.
If a charter is cancelled for any reason, we are not responsible for travel expenses, accommodation costs, or any other associated losses incurred by the customer.
2. Charter Cancellations by Go Fish Yamba Charters
We reserve the right to cancel a charter due to circumstances including, but not limited to:
Illness
Injury
Accident
Mechanical breakdown
Safety concerns
Weather conditions
If cancellation occurs, we will make every effort to reschedule your charter or provide a full refund.
3. Passenger Numbers
All mixed (shared) charters require minimum passenger numbers.
If minimum numbers are not met, we may cancel the charter. In this case, we will endeavour to reschedule your booking or offer a full refund.
4. Fishing Results
We work hard to give you the best possible chance of catching fish. However, customers must understand that catch numbers cannot be guaranteed.
A lack of fish caught is not grounds for a discount or refund.
5. Damage or Loss of Equipment
Any rods, reels, tackle, or equipment lost overboard or damaged due to customer negligence must be paid for at full replacement cost.
6. Photos, Video, and Media Use
Passengers may be photographed or filmed during the charter.
These images may be used by Go Fish Yamba Charters for advertising, promotional materials, social media, and website use.
We reserve the right to use these images without notification, compensation, or payment.
7. Punctuality
Passengers must arrive on time for their scheduled charter.
If you are running late, you must call us.
If we do not hear from you, the vessel will depart at the scheduled time and your booking and payment (or voucher) will be forfeited.
8. GPS / Navigation Devices
GPS devices, fish finders, mapping apps, or any phone-based navigational tools are not permitted on board.
If we suspect such devices are being used, we may require you to store your phone in the cabin until the end of the charter.
9. Children
All children (13 & under) must be accompanied by a responsible adult and remain under that adult’s supervision at all times.
We love taking kids fishing, but we are not babysitters.
10. Weather Conditions
All charters are subject to suitable weather conditions.
The decision to cancel due to weather or safety concerns is made solely by Go Fish Yamba Charters or the Skipper.
Marine conditions can change quickly, sometimes contrary to forecasts.
If we need to cancel due to weather, we will aim to reschedule your charter or provide a full refund.
Please ensure your phone is switched on.
Bookings & Cancellations
Mixed Charter Cancellations
Minimum of 24 hours notice is required for a refund.
If insufficient notice is provided, we will have to charge you full rate of the missing person/s.
Private Group / Whole-Boat Charter Cancellations
Minimum 7 days notice is required for a refund.
If insufficient notice is provided, we may have to charge full rate of the charter .
Gift Vouchers
Not redeemable for cash.
Not refundable in part or full.
Transferable to another individual only with prior approval from Go Fish Yamba Charters by the voucher holder.
Customer Behaviour
General Conduct
All customers must behave in a safe, respectful, and responsible manner toward staff and fellow passengers.
Damage to Equipment
Customers are liable for any loss or damage to equipment or vessels caused by negligence or unruly behaviour.
Unruly or Unsafe Behaviour
The skipper reserves the right to cancel the charter if unsafe or inappropriate behaviour occurs before or during the trip.
In such cases, payment will be forfeited and no refund issued.
Drugs and Alcohol
Illegal drugs are strictly prohibited on board.
BYO alcohol is permitted in cans only — no glass allowed.
Alcohol must be consumed in moderation.
We reserve the right to refuse service of alcohol and/or remove any passenger who becomes unsafe, unruly, or disrespectful.
Intoxicated Passengers
If a passenger arrives under the influence of drugs or alcohol, we may refuse their participation in the charter.
Abusive, threatening, or inappropriate behaviour will result in removal from the vessel.
Assistance from NSW Water Police may be requested if required.
